Whereas it is alleged that damage has been done to a certain wall, wharf, and warehouses of Macleod & Company on the Pasig River, in the City of Manila, by excessive dredging by the Bureau of Public Works which undermined the foundations of said wall and wharf; Whereas the Director of Public Works has disclaimed all responsibility for the caving-in of the aforesaid wall and wharf; Whereas the question as to who is liable for said damages can only be propeiiy determined by means of an action at law: Now, therefore, in the interest of right and justice,
