Section 53
SEC. 53. Where the register of deeds is in doubt upon any question of law, or where any party in interest does not agree as to the proper memorandum to be made in pursuance of any deed, mortgage, or other voluntary instrument presented for registration, question shall be referred to the court for decision, either on certificate of the register of deeds stating the question upon which he is in doubt or upon the suggestion in writing of any party in interest; and the court, after notice to all parties and hearing, shall enter an order prescribing the form of memorandum to the register of deeds to make registration in accordance therewith.
