SEC. 12. Penalties.—Any person who violates any provision of this Act or any regulation thereunder; or who fails to file any statement required to be filed under this Act; or in complying with the provision of this Act, makes a false statement of material fact, or omits to state any material fact required to be stated therein shall be liable on conviction to imprisonment for a term not exceeding five years or a fine not exceeding P10,000.00 or both. If the offense, is committed by a corporation, partnership, association or any other organization or entity, the penalty provided herein shall be imposed on the president, managing director, managing partner, or chief operating officer, whichever the case may be: Provided, That if the offender is a foreigner, he shall, after payment of the fine and/or service of the sentence, be subject to deportation.
