SEC. 58. There shall be paid to the provincial treasurer or to the mining recorder duly authorized to receive payment, a fee of three pesos for each original or amended declaration of location of mining claim, for each affidavit accompanying such declaration, and for each power of attorney, document, or instrument in writing, regarding or affecting the possession of mining claims or any right or title thereto, or interest therein, filed for record, and, on the presentation of the receipt of the provincial treasurer or mining recorder duly authorized to receive payment, the said declaration, affidavit, power of attorney, document or instrument in writing shall be recorded by the mining recorder: Provided, That the affidavit of the locator of the mining claim or of his, its, or their agent, required by this Act, have been filed and the fees herein required have been paid. The fees shall be accounted for as other collections of the officers receiving them, and deposited to the credit of the proper province or municipality, as the case may be, in accordance with the next following section of this Act.
