ART. 214. Determination of Average Weekly Wage. — Except as otherwise provided in this Title, the average weekly wage of die injured employee at the time of the injury shall be taken as the basis upon which to compute income benefits and shall be determined as follows: If at the time of the injury the wages are fixed by week, the amount so fixed shall be the average weekly wage. If at the time of the injury the wages are fixed by the month, the average weekly wage shall be the monthly wages so fixed multiplied by twelve and divided by fifty-two. If at the time of the injury the wages are fixed by the year, the average weekly wage shall be the yearly wage so fixed divided by fifty-two. If at the time of injury the wages are fixed by the day, hour or by the output of the employee, the average weekly wage shall be computed in such manner that it shall be the best computation that can be made of the weekly earnings of the employee during the twelve (12) weeks next preceding the injury; however, the weeks when he did not work shall be excluded in the computation. If on account of the shortness of the time during which the employee has been employed or the casual nature of terms of the employment it is not feasible to compute the average weekly wage on the basis of the injured employee's earnings from such employment, regard may be had to the average weekly wage which during the twelve (12) weeks preceding the injury was being earned by an employee in comparable employment. In occupations which are exclusively seasonal and therefore cannot be carried on throughout the year, the average weekly wage shall be taken to be one-fifteenth of the total wages which the employee has earned from all occupations during the twelve (12) calendar months immediately preceding the injury.
