SEC. 10. Penal Provisions.—Any public officer or employee found directly or indirectly responsible for the use of the net profit of the grantee for any purpose other than the improvement and expansion of the system shall be punished by a fine of not more than five thousand pesos or imprisonment for not more than two years, or both. Any public officer or employee found directly or indirectly responsible for the violation of this section or any such officer or employee who, having known such violation, fails to report the same to the justice of the peace, shall be punished with dismissal from the service and by imprisonment for not less than one year and not more than five years. Nothing in this section shall be construed to relieve or exempt the grantee from complying with the provisions of other laws relative to franchises.
