SEC. 2. The provincial and city fiscals and their assistants, whose appointments have already been confirmed by the Commission on Appointments prior to the approval of this Act, shall automatically be entitled to the benefits of this Act: Provided, That no provincial or city fiscal and their assistants shall suffer any diminution in rank or salary by virtue of the provision of this Act: Provided, further, That in case of vacancy in any grade or rank of assistant fiscals in the provinces and cities caused by the promotion, death, resignation, retirement, transfer, dismissal or other just causes, the assistant fiscals of the lower ranks or grades shall, based upon their efficiency and performance ratings, experience, integrity and seniority in the service, have preferential right of promotion to such vacant position upon recommendation of the provincial or city fiscal or the chief prosecuting attorneys of the Department of Justice.
