s 92 Board of inquiry
92.—(1) Where it is expedient that the Minister, or such other person as the Minister may appoint to exercise the powers conferred upon the Minister by this Part, should be informed on any matter connected with the government, discipline, administration or functions of the Force or affecting any person subject to this Act, the Minister or the person appointed by the Minister may convene a board of inquiry.[32/2010] (2) A board of inquiry must inquire into and report on the facts relating to any matter referred to it and, if directed by the Minister to do so, express its opinion on any question arising out of any such matter. (3) The Minister may, where a board of inquiry has found that any wrongful or negligent act or omission of a member has caused or will cause the Government to suffer any loss or to incur any liability arising from the negligent act or omission of the member, order the member (whether or not he or she is still a member when the order is made) to pay such sum as the Minister may determine as contribution to the Government for the loss or liability. (4) The Minister may write off the value of any loss which remains irrecoverable or unrecovered. (5) The Minister may exercise the powers conferred by this section even though any other person has been appointed under subsection (1). (6) In this Part, “Minister” includes the person appointed by the Minister under subsection (1) to act on his or her behalf for the purposes of this Part.
