s 17 Onus of proof, etc.

17.—(1) The onus of proving the breach of duty which is the subject of the challenge is on the applicant. (2) Except with the consent of the Tribunal and in accordance with such conditions as the Tribunal may determine, the applicant may not, at the hearing of the challenge, rely on any breach of duty other than that identified in the Notice of Challenge.
