s 39 Evidentiary certificate — classification of hazardous or other waste
39.—(1) The Director‑General may issue a written certificate stating that a specified substance or object is, or is not, in specified circumstances, hazardous or other waste —(a) for the purposes of this Act; or (b) for the purposes of the application of this Act to a specified matter.[6/2020] (2) In any proceedings relating to this Act, a certificate issued under subsection (1) is prima facie evidence of the matters stated in the certificate. (3) A copy of a certificate mentioned in subsection (1) must be published in the Gazette.
