Transitory modifications of sections 6 and 7 and Schedule 1

If— (a) no date has been appointed before the commencement of this Act as the date on which paragraph 37 of Schedule 15 to the Criminal Justice Act 1988 is to come into force, or (b) a date has been appointed which is later than the commencement of this Act, paragraph 12 of Schedule 1 and the word “12” in section 7(2) shall be omitted until the appointed day.

If— (a) no date has been appointed before the commencement of this Act as the date on which paragraph 2 of Schedule 18 to the Courts and Legal Services Act 1990 is to come into force, or (b) a date has been appointed which is later than the commencement of this Act, paragraph 10 of Schedule 1 shall be omitted until the appointed day.

In paragraphs 1, 2 and 3 “ the appointed day ” means (a) in the case mentioned in paragraph 1(a) or 2(a) , such day as may be appointed by the Secretary of State for the purposes of the paragraph concerned by order made by statutory instrument, and (b) in the case mentioned in paragraph 1(b) or 2(b) , the day appointed as the day on which the provision mentioned in paragraph 1(a) or 2(a) (as the case may be) is to come into force.
