These Regulations may be cited as the Judicial Pensions (Specification of Alternative Scheme) Regulations 2000 and shall come into force on 1st December 2000.

The Judicial Pensions (Specification of Alternative Scheme) Regulations 2000 (S.I. 2000/2984)
These Regulations are consequential upon the introduction of pension sharing by the Welfare Reform and Pensions Act 1999. Their effect is that when a pension sharing order is made in respect of the rights of any person under a judicial pension scheme other than that constituted under the Judicial Pensions and Retirement Act 1993, and the scheme in question is closed to new members, the person in whose favour the order is made acquires rights under the scheme constituted under the Judicial Pensions and Retirement Act 1993.

In these Regulations:—
“the 1993 Act ” means the Judicial Pensions and Retirement Act 1993 ;
“the 1999 Act ” means the Welfare Reform and Pensions Act 1999;
“judicial pension scheme” has the meaning given by section 30(1) of the 1993 Act.
(1) This regulation applies to every judicial pension scheme other than a scheme constituted by or under the 1993 Act.
(2) Where a scheme to which this regulation applies is closed to new members, the scheme constituted by Part I of the 1993 Act is specified as an alternative to it for the purposes of paragraph 2(5) of Schedule 5 to the 1999 Act.
