Section 1 Citation, commencement and application

(1) This Order may be cited as the Public Audit (Wales) Act 2004 (Consequential Amendments) (Wales) Order 2005 and comes into force on 1 April 2005.

(2) This Order applies in relation to Wales only.

Section 2 Subordinate legislation amended

(1) The Local Authorities (Companies) Order 1995 is amended as follows.

(2) In article 9, omit the words from “the Audit Commission ’s consent” to the end, and substitute “the consent of —

where the company is under the control of one or more local authorities, all of which are local government bodies in Wales within the meaning of section 12 of the Public Audit (Wales) Act 2004, the Auditor General for Wales;

in any other case, the Audit Commission,

to the appointment of that person.

Section 3 Subordinate legislation amended

(1) The Construction Contracts (England and Wales) Exclusion Order 1998 is amended as follows.

(2) In article 4(2)(c)(v), at the end, insert the words “or the Auditor General for Wales”.
