(1) If, with intent to defraud, a farmer who has created an agricultural charge— (a) fails to comply with the obligations imposed by this Act as to the payment over to the bank of any sums received by him by way of proceeds of sale, or in respect of other agricultural assets, or under a policy of insurance or by way of compensation; or (b) removes or suffers to be removed from his holding any property subject to the charge; he shall be guilty of a misdemeanour and liable on conviction on indictment to penal servitude for a term not exceeding three years.
