Where a devolution issue arises in any proceedings before a court or tribunal the court or tribunal shall order intimation of it to be given to the Lord Advocate and to any person who, as a Scottish Secretary or assistant to a Scottish Secretary, performs functions corresponding to those performed by a Law Officer of the Crown (unless the person to whom the intimation would be given. is a party to the proceedings).
