(1) Section 52A of the Further and Higher Education Act 1992 (duty to safeguard pupils receiving secondary education) is amended as follows. (2) In subsection (1)— (a) for “persons who would, if they were pupils at a school, be in the fourth key stage” there is substituted “ persons of compulsory school age ” , and (b) in paragraph (a), for “in pursuance of arrangements falling within section 18(1)(aa) of this Act” there is substituted “ by virtue of section 18(1)(aa) or (ab) of this Act ” . (3) In subsection (2) for “such pupils” there is substituted “ persons of compulsory school age ” .
