(1) Section 409 of the Education Act 1996 (complaints and enforcement: maintained schools) is amended as follows. (2) In subsection (1), the words “with the approval of the Secretary of State and” are omitted. (3) In subsection (2), after “by the authority” there is inserted “ , any maintained nursery school so maintained ” . (4) In subsection (3), before the “and” at the end of paragraph (a) there is inserted— (aa) any provision which by virtue of section 408(4A) is a relevant provision of the Education Act 2002 for the purposes of section 408(1),
