s 41 Penalties on conviction
(1) In section 33 of the Environmental Protection Act 1990 (offence of unauthorised or harmful deposit etc of waste), for subsections (8) and (9) (penalties) substitute— (8) A person who commits an offence under this section is liable— (a) on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding £50,000 or both; (b) on conviction on indictment, to imprisonment for a term not exceeding five years or a fine or both. (2) Subsection (1) does not have effect in relation to offences committed before the commencement of this section. (3) In relation to offences committed after 2 May 2022 , the amendment made by this section has effect as if for “ the general limit in a magistrates’ court ” there were substituted “ 6 months ” .
