(1) If a person contravenes paragraph 5(1) the responsible authority may give an enforcement notice. (2) The notice may be given to— (a) the person who contravened paragraph 5(1), or (b) the owner of the designated structure or feature. (3) The notice must direct the recipient to take specified steps, within a specified period, to remedy the contravention. (4) If a person (P) fails to comply with an enforcement notice— (a) P commits an offence and is liable on summary conviction to a fine not exceeding level 5 on the standard scale, (b) the responsible authority may authorise a person to take the steps specified in the notice, (c) the responsible authority may require P to pay expenses incurred under paragraph (b), and (d) payment required under paragraph (c) is recoverable as a debt.
