In section 4 (powers of the HCA: general) in subsection (6) for the “and” at the end of paragraph (a) substitute— (aa) subsections (2) to (5) do not apply to the powers conferred on the HCA— (i) as the regulator by virtue of Part 2 (but see section 92I (exercise of functions)), or (ii) as the Regulator of Social Housing by virtue of any other enactment or instrument, and
