Sch 5 para 1
Section 21(2) does not apply to an order under section 5 which provides for— (a) functions of the British Waterways Board falling within section 21(3)(b) to (e) to be transferred to another person; (b) functions of the Environment Agency falling within section 21(3)(b) to (e) to be transferred to a person to whom functions of the British Waterways Board are transferred by virtue of paragraph (a).
