Sch 1 para 9
(1) This paragraph applies in relation to any penalty payable to the Commissioner by virtue of a monetary penalty notice. (2) In England and Wales or Northern Ireland, the penalty is recoverable— (a) if the county court in England and Wales or a county court in Northern Ireland so orders, as if it were payable under an order of that court, and (b) if the High Court so orders, as if it were payable under an order of that court. (3) In Scotland, the penalty is recoverable as if it were payable under an extract registered decree arbitral bearing a warrant for execution issued by the sheriff for any sheriffdom in Scotland.
