In article 36— (a) in paragraph (1), after “but” insert “, subject to paragraph (4)” ; (b) after paragraph (3) insert— (4) The restrictions that would otherwise apply by virtue of paragraph (1)(a) or (3) do not apply where the Welsh Ministers are satisfied that their application is not necessary to reduce the risk of the spread of avian influenza.
