Article 1

The State aid which Germany has implemented for SKET Walzwerkstechnik GmbH, Magdeburg, amounting to EUR 70 million (DEM 143,5 million) is compatible with the common market within the meaning of Article 87(1) of the Treaty, subject to the conditions set out in Article 2.

Article 2

1. The restructuring plan must fully be implemented. All possible measures shall be taken to ensure that the plan is put into effect. 2. Germany shall submit an annual report to the Commission on the implementation of the restructuring plan. 3. If the conditions set out in paragraphs 1 and 2 are not fulfilled, the exemption can be withdrawn.
