The loans granted by EEL GmbH to FN GmbH on 11 April 2004, 17 June 2004 and 28 July 2004, and the support measures granted by the District of Kleve and the Commune of Weeze to EEL GmbH do not constitute aid within the meaning of Article 107(1) of the Treaty on the Functioning of the European Union.
1. The loan granted by EEL GmbH to FN GmbH on 1 July 2005 as well as the roll-over on 1 July 2005 of all existing loans granted by EEL GmbH to FN GmbH, the support measure granted by the Land Nordrhein-Westfalen to FN GmbH and the support measure granted from the district of Kleve directly to FN GmbH concerning the acquisition of the real estate of the Niederrhein-Weeze airport constitute State aid within the meaning of Article 107(1) of the Treaty on the Functioning of the European Union compatible with the internal market under Article 107(3)(c) of the Treaty on the Functioning of the European Union. 2. The roll-over of all existing loans granted by EEL GmbH to FN GmbH on 29 November 2010, if it constitutes State aid within the meaning of Article 107(1) of the Treaty on the Functioning of the European Union, is compatible with the internal market compatible with the internal market under Article 107(3)(c) of the Treaty on the Functioning of the European Union.
This Decision is addressed to the Federal Republic of Germany.
