Surrender

Article 15

1.   A declaration of surrender pursuant to Article 57(2) of Regulation (EU) 2017/1001 shall contain: (a) the registration number of the EU trade mark; (b) the name and address of the proprietor in accordance with Article 2(1)(b) of this Regulation; (c) where surrender is declared only for some of the goods or services for which the mark is registered, an indication of the goods or services for which the mark is to remain registered. 2.   Where a right of a third party relating to the EU trade mark is entered in the Register, a declaration of consent to the surrender, signed by the proprietor of that right or a representative of that proprietor, shall be sufficient proof of the third party's agreement to the surrender.
