Commission Implementing Directive (EU) 2024/3010 of 29 November 2024 amending Council Directives 2002/55/EC and 2002/57/EC, and Commission Directive 93/61/EEC as regards the listing of pests of plants on seeds and other plant reproductive material

Amendment of Directive 2002/55/EC

Article 1

Annex II to Directive 2002/55/EC is amended as set out in point 1 of the Annex to this Directive.

Amendment of Directive 2002/57/EC

Article 2

Annex II to Directive 2002/57/EC is amended as set out in point 2 of the Annex to this Directive.

Amendment of Directive 93/61/EEC

Article 3

The Annex to Directive 93/61/EEC is amended as set out in point 3 of the Annex to this Directive.

Transposition

Article 4

1.   Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 May 2025 at the latest. They shall forthwith communicate to the Commission the text of those provisions. When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made. 2.   Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

Entry into force

Article 5

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

Article 6

This Directive is addressed to the Member States.

ANNEXSupplementary provisions

ANNEX 1.    In Annex II, point 3(b) to Directive 2002/55/EC, the following row is added to the table under the title ‘Viruses, viroids, virus-like diseases and phytoplasmas’: ‘Tomato brown rugose fruit virus [ToBRFV] Capsicum annuum L., other than seeds belonging to a variety known to be resistant to ToBRFV. Solanum lycopersicum L. and hybrids thereof. 0 %’ 2.    In Annex II, point (5) of Section I to Directive 2002/57/EC, the following table is added: ‘ Viruses, viroids, virus-like diseases and phytoplasmas RNQPs or symptoms caused by RNQPs Plants for planting (genus or species) Thresholds for pre-basic seed Thresholds for basic seed Thresholds for certified seed Tobacco ringspot virus [TRSV00] Glycine max (L.) Merr. 0  % 0  % 0  %’ 3.    In the Annex to Directive 93/61/EEC, the following row is inserted between the third and the fourth row of the table of ‘Viruses, viroids, virus-like diseases and phytoplasmas’: ‘Tomato brown rugose fruit virus (ToBRFV) Capsicum annuum L., other than material belonging to a variety known to be resistant to ToBRFV. Solanum lycopersicum L. and hybrids thereof. 0  %’
