Article 1

1.   For the purpose of reporting to the Commission an estimate of the total annual emissions of sulphur dioxide (SO 2 ), nitrogen oxides (NO x ) and dust pursuant to Article 11(1) of Directive (EU) 2015/2193, Member States shall use the format set out in Annex I to this Decision.

2.   For the purpose of reporting to the Commission qualitative and quantitative information on the implementation of Directive (EU) 2015/2193, on any action taken to verify compliance of the operation of medium combustion plants with Directive (EU) 2015/2193 and on any enforcement action for the purposes thereof, pursuant to Article 11(1) of Directive (EU) 2015/2193, Member States shall use the format set out in Annex II to this Decision.

3.   Member States shall use the electronic reporting tool referred to in Article 11(3), first subparagraph, of Directive (EU) 2015/2193 to submit the information requested in Annexes I and II to this Decision.

This Decision is addressed to the Member States.

ANNEX I

TECHNICAL FORMAT FOR REPORTING INFORMATION ON MEDIUM COMBUSTION PLANTS COVERED BY DIRECTIVE (EU) 2015/2193

PART 1

Plant categories

This table provides the plant categories to be used for providing the information required under parts 2 and 3  ( 1 ) .

1.1

New or existing

As defined under Article 3(6) and (7) of Directive (EU) 2015/2193

Emissions, energy input and capacity

3.1

SO 2 , NO x and dust emissions

Estimated emissions of sulphur dioxide, nitrogen oxides and dust expressed as the total quantity in tonnes per calendar year discharged by plants for each plant category

3.2

Energy input

Estimated total fuel used by the plants expressed in tera joules per year for each plant category

3.3

Total aggregated capacity

Estimated total installed capacity expressed as the sum of the rated thermal input of all the plants for each plant category

( 1 )   Example of category: new boilers larger than 5 MW th and lower or equal to 20 MW th combusting liquid fuels other than gas oil.

( 2 )   For new medium combustion plants, the total rated thermal input may be used.

( 3 )   Preferably 2025. If not possible, 2024 or 2023, whichever year where the most recent data is available. For the second report, preferably 2030. If not possible, 2029 or 2028, whichever year where the most recent data is available.

ANNEX II

TECHNICAL FORMAT FOR REPORTING INFORMATION ON MEDIUM COMBUSTION PLANTS COVERED BY DIRECTIVE (EU) 2015/2193

For the purpose of reporting the information set out in this Annex to the Commission, any reference to ‘Plant category’ should be understood as a reference to the table ‘Part 1, Plant categories’ set out in Annex I to this Decision.

2.7

Stricter emission limit values

Overview of cases where stricter emission limit values are in force in respect of Article 6(9) of Directive (EU) 2015/2193 in the reporting year (brief description of reasons and procedures for application of stricter ELVs). This information is reported for each plant category when this information is available at this level.

2.8

Changes to medium combustion plants

Examples of measures referred to in Article 9 of Directive (EU) 2015/2193 aimed at ensuring that the operator informs the competent authority of planned changes to the medium combustion plants which would affect the applicable emission limit values

2.9

System for compliance check

Method used to verify that emissions monitored, with continuous or periodic measurements, do not exceed the emission limit values referred to Article 6 of Directive (EU) 2015/2193 (description of the system referred to in Article 8 of Directive (EU) 2015/2193 such as use of inspections, self-measurements, external measurements or other measures, use of accredited organisations to carry out controls).

2.10

Enforcement actions taken

Overview of enforcement actions taken in the event of non-compliance as referred to in Article 8 of Directive (EU) 2015/2193, into the reporting year (brief description of the procedures established to enforce the Directive and types of enforcement actions), including the penalties set out in Article 16 of Directive (EU) 2015/2193.

2.11

Suspension of operations

Summary of the type of cases of non-compliance referred to in Article 8 of Directive (EU) 2015/2193 having led to suspension of operations.

( 1 )   For the first report, preferably 2025. If not possible, 2024 or 2023, whichever year where the most recent data is available. For the second report, preferably 2030. If not possible, 2029 or 2028, whichever year where the most recent data is available.
