Article 9

Except in cases of force majeure, successful tenderers shall bear all risks to which the goods may be subject, and in particular their loss or deterioration, up to the appointed supply stage. The Commission may, in order to take account of particular difficulties, allow a tolerance in so far as unidentifiable losses are concerned.
