Article 70

1.   The authorising officer responsible shall make a financial commitment before entering into a legal commitment, binding upon the Commission, with third parties. 2.   Financing decisions taken by the Commission, in accordance with the ACP-EC Agreement or the Overseas Association Decision, which authorise it to grant financial aid from the EDF, shall give rise to financial commitments by the Commission. 3.   The following shall constitute legal commitments by the Commission: (a) a financing agreement between the Commission, acting on behalf of the Community, and the beneficiary ACP States or the beneficiary OCTs or the bodies they have designated; (b) a contract or grant agreement between the Commission and national or international public-sector bodies or natural or legal persons responsible for carrying out the actions. 4.   Each financing agreement, contract or grant agreement shall provide expressly for the Commission, OLAF and the Court of Auditors, to exercise their powers of control, on documents and on the spot, over all contractors and subcontractors who have received financing from EDF resources.
