Nothing in this Article shall prohibit the lowering of any person from a helicopter to the surface, if the certificate of airworthiness issued or rendered valid in respect of the helicopter under the law of— (a) if there is no Article 83 bis transfer of the functions and duties under Article 31 of the Chicago Convention in respect of the helicopter, the country in which the helicopter is registered; or (b) if there is such a transfer, the state of the operator of the helicopter, includes an express provision that it may be used for that purpose.
