s 33 Penalties, obtaining registration by false pretences, etc.

Any person, sole proprietorship, partnership or body corporate who— (a) procures or attempts to procure registration or a certificate of registration under this Act by knowingly making or producing or causing to be made or produced any false or fraudulent declaration, certificate, application or representation whether in writing or otherwise; (b) wilfully makes or causes to be made any falsification in any Register kept and maintained under this Act; (c) forges, alters or counterfeits any certificate of registration under this Act; (d) utters or uses any forged, altered or counterfeited certificate of registration under this Act knowing the same to have been forged, altered or counterfeited; (e) impersonates a Professional Architect, registered Architect, registered Building Draughtsman; (f) buys or fraudulently obtains a certificate of registration under this Act issued to another Professional Architect, registered Architect, registered Building Draughtsman or architectural consultancy practice; (g) sells any certificate of registration issued under this Act; or (h) contravenes section 7, or subsection 15A(6) or 34B(5), shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or imprisonment for a term not exceeding two years or to both. *NOTE—All proceedings under this section pending before 1 December 2002 shall be continued as if this Act had not been amended by Act A1159–see subsection 41(5) of Act A1159.
