s 18 Existing societies of students

(1) Where on the date of commencement of this Act there stands registered under the Societies Act 1966 or the *Co-operative Societies Ordinance 1948 of Peninsular Malaysia [F.M. Ord. 33 of 1948], or the Co-operative Societies Ordinance 1958 of Sabah [Ord. 3 of 1958], or the Co-operative Societies Ordinance of Sarawak [Cap. 66], any society or co-operative society, as the case may be, whose members are wholly or predominantly students of one or more Institutions the said society or co-operative society, as the case may be, shall stand dissolved upon the expiry of fourteen days from the date of commencement of this Act, unless during that period the written approval of the Minister is obtained and filed with the Registrar of Societies or with the relevant Registrar of Co-operative Societies, as the case may be. (2) Where a society is dissolved under subsection 17(1) of the Societies Act 1966 shall apply in respect thereof mutatis mutandis as if it were a society the registration whereof had been cancelled under the said Act. (3) Where a co-operative society is dissolved under subsection (1) the relevant Registrar of Co-operative Societies shall appoint a competent person to be, subject to the direction and control of such Registrar of Co-operative Societies, liquidator of such co-operative society and the provisions of the relevant Co-operative Societies Ordinance shall apply to such co-operative society as if it were a co-operative society the registration whereof had been cancelled under that Ordinance and the said liquidator had been appointed a liquidator thereof under section 41 of that Ordinance. (4) Where a person who was a member of a society or a co-operative society when he was a student of an Institution had continued to be a member thereof after he had ceased to be a student of an Institution, he shall, for the purpose of determining under this section whether the members of the society or co-operative society are wholly or predominantly students of one or more Institutions, be deemed to be a student of an Institution. (5) Any question as to whether the members of any society or co-operative society, as the case may be, are wholly or predominantly students of one or more Institutions shall be decided by the Registrar of Societies or the relevant Registrar of Co-operative Societies, as the case may be, and his decision thereon shall be final and shall not be questioned or reviewed in any court. *NOTE—Societies Act 1966 [Act 335] has been revised and named as Societies Act 1966 [Act 832] which comes into operation on 1 December 2021. **NOTE—The Co-operative Societies Ordinance 1948 [F.M. Ord. 33 of 1948] has been repealed by s. 95 of the Co-operative Societies Act 1993 [Act 502].

Persatuan pelajar yang sedia ada

(1) Jika pada tarikh mula berkuat kuasanya Akta ini ada didaftarkan di bawah Akta Pertubuhan 1966, atau **Ordinan Syarikat Kerjasama 1948, Malaysia Barat [Ord. P.T.M. 33 tahun 1948], atau Ordinan Syarikat Kerjasama 1958, Sabah [Ord. 3 tahun 1958], atau Ordinan Syarikat Kerjasama Sarawak [Bab 66], sesuatu persatuan atau syarikat kerjasama, mengikut mana-mana yang berkenaan, yang anggotanya adalah kesemuanya atau kebanyakannya pelajar daripada satu Institusi atau lebih maka persatuan atau syarikat kerjasama tersebut, mengikut mana-mana yang berkenaan, hendaklah terbubar apabila tamat tempoh empat belas hari dari tarikh mula berkuat kuasanya Akta ini, melainkan jika dalam masa tempoh itu kelulusan bertulis Menteri adalah diperoleh *CATATAN—Akta Pertubuhan 1966 [Akta 335] telah disemak dan dinamakan sebagai Akta Pertubuhan 1966 [Akta 832] yang mula berkuat kuasa pada 1 Disember 2021. **CATATAN—Ordinan Syarikat Kerjasama 1948, Malaysia Barat [Ord. P.T.M. 33 tahun 1948] telah dimansuhkan oleh seksyen 95 Akta Koperasi 1993 [Akta 502]. dan difail dengan Pendaftar Pertubuhan atau dengan Pendaftar Syarikat Kerjasama yang berkenaan, mengikut mana-mana yang berkenaan. (2) Jika sesuatu persatuan dibubarkan di bawah subseksyen 17(1) Akta Pertubuhan 1966, hendaklah terpakai mengenainya mutatis mutandis seolah-olah ia adalah suatu persatuan yang pendaftarannya telah dibatalkan di bawah Akta tersebut. (3) Jika sesuatu syarikat kerjasama dibubarkan di bawah subseksyen (1) Pendaftar Syarikat Kerjasama yang berkenaan hendaklah melantik seorang yang berwibawa untuk menjadi pelikuidasi syarikat kerjasama itu, tertakluk pada arahan dan kawalan Pendaftar Syarikat Kerjasama dan peruntukan Ordinan Syarikat Kerjasama yang berkenaan hendaklah terpakai bagi syarikat kerjasama itu seolah-olah ia adalah suatu syarikat kerjasama yang pendaftarannya telah dibatalkan di bawah Ordinan itu dan pelikuidasi tersebut telah dilantik sebagai pelikuidasinya di bawah seksyen 41 Ordinan itu. (4) Jika seseorang yang telah menjadi anggota sesuatu persatuan atau sesuatu syarikat kerjasama semasa ia seorang pelajar sesuatu Institusi telah terus menjadi anggotanya selepas ia telah berhenti daripada menjadi seorang pelajar sesuatu Institusi, maka ia hendaklah, bagi maksud menentukan di bawah seksyen ini sama ada anggota persatuan atau syarikat kerjasama itu adalah kesemuanya atau kebanyakannya pelajar daripada satu Institusi atau lebih, disifatkan sebagai seorang pelajar sesuatu Institusi. (5) Apa-apa soalan tentang sama ada ahli sesuatu persatuan atau sesuatu syarikat kerjasama, mengikut mana-mana yang berkenaan, adalah kesemuanya atau kebanyakannya pelajar daripada satu Institusi atau lebih hendaklah diputuskan oleh Pendaftar Pertubuhan atau Pendaftar Syarikat Kerjasama yang berkenaan, mengikut mana-mana yang berkenaan, dan keputusannya mengenai soal itu adalah muktamad dan tidak boleh dipersoalkan atau dikaji semula dalam mana-mana mahkamah.
