s 31 Time for registration
(1) Subject to subsection (2) a trade mark shall not be registered after twelve months from the date of the advertisement of the acceptance of the application for registration of the trade mark.
(2) Where the registration of a trade mark is delayed by—
(a) opposition to the registration of the trade mark;
(b) any appeal made to the Court; or
(c) an action on the part of the Central Trade Marks office or any trade marks office,
that trade mark may be registered within such time as directed by the Registrar or the Court respectively.
(3) Where a trade mark has not been registered within the time applicable to it the application shall lapse.

Masa untuk pendaftaran
(1) Tertakluk kepada subseksyen (2), sesuatu cap dagangan tidak boleh didaftarkan selepas dua belas bulan dari tarikh diiklankan penyetujuterimaan permohonan untuk pendaftaran cap dagangan itu.
(2) Jika pendaftaran sesuatu cap dagangan terlambat oleh sebab—
(a) bangkangan terhadap pendaftaran cap dagangan itu;
(b) sesuatu rayuan dibuat kepada Mahkamah; atau
(c) sesuatu tindakan pihak Pejabat Pusat Cap Dagangan atau mana-mana pejabat cap dagangan,
cap dagangan itu bolehlah didaftarkan dalam apa-apa tempoh yang diarahkan oleh Pendaftar atau Mahkamah, mengikut mana-mana yang berkenaan.
(3) Jika sesuatu cap dagangan tidak didaftarkan dalam tempoh yang berkenaan dengannya, permohonan itu hendaklah luput masanya.
