s 36 Registration prima facie evidence of validity

In all legal proceedings relating to a registered trade mark (including applications under section 45) the fact that a person is registered as proprietor of the trade mark shall be prima facie evidence of the validity of the original registration of the trade mark and of all subsequent assignments and transmissions thereof.

Pendaftaran adalah keterangan prima facie mengenai sahnya pendaftaran asal cap dagangan, dsb.

Dalam semua prosiding di sisi undang-undang berkenaan dengan sesuatu cap dagangan berdaftar (termasuk permohonan di bawah seksyen 45) fakta bahawa seseorang adalah didaftarkan sebagai tuan punya cap dagangan itu adalah keterangan prima facie mengenai sahnya pendaftaran asal cap dagangan itu dan sahnya semua penyerahhakan dan perpindahannya yang kemudian.
