s 42 Status of unrenewed trade mark
Where a trade mark has been removed from the Register for non-payment of the fee for renewal, it shall, nevertheless, for the purpose of an application for the registration of a trade mark within one year from the date of expiration of the last registration be deemed to be a trade mark which is already on the Register except that this section shall not have effect when the Registrar is satisfied eitherβ
(a) that there has been no use in good faith of the trade mark which has been removed during the two years immediately preceding its removal; or
(b) that no deception or confusion is likely to arise from the use of the trade mark which is the subject of the application for registration by reason of any previous use of the trade mark which has been removed.

Taraf cap dagangan yang tidak dibaharui
Jika sesuatu cap dagangan telah dihapuskan dari Daftar kerana bayaran bagi pembaharuannya tidak dijelaskan, cap dagangan itu hendaklah, bagaimana jua pun, bagi maksud permohonan untuk mendaftarkan sesuatu cap dagangan dalam tempoh satu tahun dari tarikh tamatnya pendaftaran yang akhir itu disifatkan sebagai suatu cap dagangan yang telah pun berada dalam Daftar kecuali bahawa peruntukan yang di atas tidak berkuat kuasa apabila Pendaftar berpuas hati sama adaβ
(a) bahawa tiada apa-apa penggunaan suci hati telah dilakukan mengenai cap dagangan yang dihapuskan itu dalam masa dua tahun sebelum sahaja ia dihapuskan; atau
(b) bahawa tiada apa-apa perdayaan atau kekeliruan mungkin timbul dari penggunaan cap dagangan yang dipohon untuk didaftarkan itu oleh sebab apa-apa penggunaan yang dilakukan dahulu mengenai cap dagangan yang dihapuskan itu.
