s 61 Certificate of validity

In any legal proceedings in which the validity of a registered trade mark comes into question and is decided in favour of the registered proprietor of the trade mark, the Court may certify to that effect, and if it so certifies then in any subsequent legal proceedings in which the validity of the registration comes into question the registered proprietor of the trade mark on obtaining a final order or judgment in his favour shall have his full costs, charges and expenses as between solicitor and client, unless in the subsequent proceedings the Court certifies that he ought not to have them.

Perakuan sahnya cap dagangan berdaftar

Jika dalam sesuatu prosiding di sisi undang-undang sahnya sesuatu cap dagangan berdaftar adalah dipersoalkan dan keputusan dibuat untuk faedah tuan punya berdaftar cap dagangan itu, maka bolehlah Mahkamah memperakui yang demikian dan jika Mahkamah memperakui sedemikian, jika sahnya pendaftaran itu dipersoalkan dalam suatu pembicaraan di sisi undang-undang yang kemudian, tuan punya berdaftar cap dagangan itu berhak, apabila mendapat suatu perintah atau hukuman muktamad untuk faedahnya, mendapat kos, bayaran dan belanja penuh sebagai antara peguam cara dengan pelanggan, melainkan jika dalam perbicaraan yang kemudian itu Mahkamah memperakui bahawa tuan punya berdaftar itu tidak patut mendapatnya.
