s 74 Powers of Registrar to amend document

(1) The Registrar may on such terms as to costs as he thinks just whether for the purpose of correcting a clerical error or an obvious mistake, permit the correction of an application for the registration of a trade mark or notice of opposition or other document submitted at any trade marks office. (2) An amendment of an application shall not be permitted under this section if the amendment would substantially affect the identity of the trade mark as specified in the application before amendment. (3) A decision of the Registrar under subsection (1) is subject to appeal to the Court.

Kuasa Pendaftar meminda dokumen

(1) Pendaftar boleh, atas apa-apa syarat mengenai kos sebagaimana yang difikirkannya patut sama ada bagi maksud membetulkan sesuatu kesilapan dari segi tulisan atau sesuatu kesilapan yang nyata, membenar dibetulkan sesuatu permohonan pendaftaran cap dagangan atau notis bangkangan atau lain-lain dokumen yang dikemukakan di sesuatu pejabat cap dagangan. (2) Sesuatu pindaan bagi sesuatu permohonan tidak boleh dibenarkan di bawah seksyen ini jika pindaan itu akan menyentuh pada substansialnya identiti cap dagangan itu sebagaimana yang ditentukan dalam permohonan itu sebelum pindaan. (3) Sesuatu keputusan Pendaftar di bawah subseksyen (1) adalah tertakluk kepada rayuan kepada Mahkamah.
