(1) No person shall be entitled to initiate any action to prevent or to recover damages for the infringement of an unregistered trade mark. (2) Notwithstanding subsection (1), nothing in this Act shall be deemed to affect the right of action against any person for passing off goods or services as those of another person or the remedies in respect thereof.
Cap dagangan tidak berdaftar
(1) Tiada sesiapa jua berhak mengambil apa-apa tindakan bagi mencegah pelanggaran terhadap sesuatu cap dagangan tidak berdaftar atau menuntut gantirosak kerananya. (2) Walau apa pun, apa-apa jua peruntukan subseksyen (1), tiada apa-apa jua dalam Akta ini boleh disifatkan sebagai menyentuh hak untuk mengambil tindakan terhadap sesiapa jua kerana mengelirupakan barang-barang atau perkhidmatan sebagai barang-barang atau perkhidmatan seorang lain atau remidi mengenainya.
