s 77 Penalty for assaulting or obstructing excise officers and rescuing goods

Every person who— (a) assaults or obstructs any officer of excise, or other public servant, or any person acting in aid of him, or duly employed for the prevention of offences under this Act, in the execution of his duty or in the due seizing of any goods liable to seizure under this Act; (b) rescues or endeavours to rescue, or causes to be rescued, anything which has been duly seized; or (c) before or after any seizure, staves in, breaks or otherwise destroys any vessel, receptacle, container or package whatsoever, or the contents thereof, to prevent the seizure thereof or the securing of the same, shall be guilty of an offence and shall be liable— (i) on the first conviction, to imprisonment for a term not exceeding †three years or to a fine not exceeding ten thousand ringgit or to both such imprisonment and fine; and (ii) on the second or subsequent conviction, to imprisonment for a term not exceeding ††five years or to a fine not exceeding twenty thousand ringgit or to both. *NOTE—Previously “eighteen months”–see the Excise (Amendment) Act 1990 [Act A781]. **NOTE—Previously “one thousand” –see the Excise (Amendment) Act 1990 [Act A781]. ***NOTE—Previously “five thousand” –see the Excise (Amendment) Act 1990 [Act A781]. †NOTE—Previously “twelve months or to a fine not exceeding five thousand ringgit”–see the Excise (Amendment) (No. 2) Act 2002 [Act A1184]. ††NOTE—Previously “eighteen months or to a fine not exceeding five thousand ringgit” –see the Excise (Amendment) (No. 2) Act 2002 [Act A1184].
