Oaths and Affirmations Act 1949 s 5

s 5 Taking of oaths out of Peninsular Malaysia

Any oath or affidavit required for the purpose of any court or matter in Peninsular Malaysia, or for the purpose of the registration of any instrument in any part of Peninsular Malaysia, may be taken or made in any place out of Peninsular Malaysia before any person having authority to administer an oath in that place: Provided that, subject to section 3 of the Diplomatic and Consular Officers (Oaths and Fees) Act 1959 [Act 348], this section shall not apply to any oath required to be taken for the purposes of the Constitution.

Mengangkat sumpah di luar Semenanjung Malaysia

Apa-apa sumpah atau afidavit yang dikehendaki bagi maksud mana-mana mahkamah atau perkara di Semenanjung Malaysia, atau bagi maksud pendaftaran apa-apa surat cara di mana-mana bahagian Semenanjung Malaysia, boleh diangkat atau dibuat di mana-mana tempat di luar Semenanjung Malaysia di hadapan manamana orang yang mempunyai kuasa untuk mengendalikan sumpah di tempat itu: Dengan syarat bahawa, tertakluk kepada seksyen 3 Akta Pegawai- Pegawai Diplomat dan Konsul (Sumpah dan Fi) 1959 [Akta 348], seksyen ini tidak terpakai bagi apa-apa sumpah yang dikehendaki diangkat bagi maksud Perlembagaan.
