Where the High Court is satisfied that there has been default by a trustee or person acting in a fiduciary capacity in payment into court of any sum in his possession or under his control, the court may commit such trustee or person to prison for a term which may extend to six months:
Provided that—
(a) no such committal shall be ordered, if it appears to the court that the trustee or person aforesaid has acted innocently in the matter; and
(b) upon payment of the amount due the prisoner shall be immediately released.

Pengkomitan pemegang amanah ingkar, dsb.
Jika Mahkamah Tinggi berpuas hati bahawa pemegang amanah atau orang yang tertindak atas sifat fidusiari telah ingkar membayar ke dalam mahkamah apa-apa jumlah wang di dalam miliknya atau di bawah kawalannya, mahkamah itu boleh mengkomitkan pemegang amanah atau orang itu selama tempoh yang boleh sampai enam bulan:
Dengan syarat bahawa —
(a) tiada apa jua pengkomitan sedemikian boleh diperintahkan, jika didapati oleh mahkamah bahawa pemegang amanah atau orang yang tersebut dahulu itu bertindak dengan suci hati dalam perkara itu; dan
(b) selepas pembayaran amaun yang kena dibayar, banduan itu hendaklah dilepaskan dengan serta merta.
