s 23 Compensation for improper arrest or attachment
(1) If at any subsequent stage of an action in which an order for arrest or attachment of property has been made under this Act it appears to the court that such arrest or attachment was applied for on insufficient grounds, or if the plaintiff’s claim is dismissed and it appears to the court that there was no sufficient ground for instituting the action, the court may, on the application of the defendant, award against the plaintiff such amount, not exceeding one thousand ringgit, as it deems reasonable to compensate the defendant for any injury caused to him by the arrest or attachment.
(2) An award under this section shall bar any action for damages, but nothing in this section shall preclude the defendant from maintaining an action for damages instead of applying for an award under subsection (1).

Pampasan kerana penangkapan atau penahanan tak wajar
(1) Jika pada mana-mana peringkat kemudian sesuatu tindakan di mana suatu perintah bagi penangkapan atau penahanan harta telah dibuat di bawah Akta ini mahkamah berpendapat bahawa penangkapan atau penahanan tersebut dipohon atas alasan yang tidak mencukupi, atau sekiranya tuntutan plaintif dibuang dan mahkamah berpendapat tidak ada alasan yang cukup bagi membawa tindakan itu, mahkamah boleh, atas permohonan defendan, mengaward atas plaintif apa-apa amaun tidak lebih daripada satu ribu ringgit sebagaimana disifatkan munasabah bagi memberi pampasan kepada defendan kerana apa-apa kerugian yang dialaminya akibat penangkapan atau penahanan itu.
(2) Sesuatu award di bawah seksyen ini hendaklah menghalang apa-apa tindakan ganti rugi tetapi tiada apa jua dalam seksyen ini boleh mencegah defendan daripada menyenggara sesuatu tindakan ganti rugi sebagai ganti memohon sesuatu award dibawah subseksyen (1).
