s 4 Restrictions on making of adoption orders
(1) An adoption order shall not be made unless the applicant or, in the case of a joint application, one of the applicants—
(a) has attained the age of twenty-five and is at least twentyone years older than the child in respect of whom the application is made unless the Court is satisfied that there are special circumstances for the making of an order;
(b) has attained the age of twenty-one and is a relative of the child; or
(c) is the mother or father of the child.
(2) An adoption order shall not be made in any case where the sole applicant is a male and the child in respect of whom the application is made is a female unless the Court is satisfied that there are special circumstances which justify as an exceptional measure the making of an order.
(3) An adoption order shall not be made in favour of any applicant who is not ordinarily resident in Peninsular Malaysia or in respect of any child who is not so resident.
(4) An adoption order shall not be made in respect of any child unless—
(a) the child has been continuously in the care and possession of the applicant for at least three consecutive months immediately preceding the date of the order; and
(b) the applicant has at least three months before the date of the order by a written notification informed an officer of the Social Welfare Department of the State in which he is for the time being resident of his intention to apply for an adoption order in respect of the child.

Sekatan ke atas pembuatan perintah pengangkatan
(1) Sesuatu perintah pengangkatan tidak boleh dibuat melainkan jika pemohon itu atau, dalam hal permohonan bersama, seorang daripada pemohon itu—
(a) telah mencapai umur dua puluh lima tahun dan adalah sekurang-kurangnya dua puluh satu tahun lebih tua daripada anak yang berkenaan dengannya permohonan itu dibuat melainkan jika Mahkamah berpuas hati bahawa terdapat hal keadaan khas bagi membuat suatu perintah;
(b) telah mencapai umur dua puluh satu tahun dan ialah saudara anak itu; atau
(c) ialah ibu atau bapa anak itu.
(2) Sesuatu perintah pengangkatan tidak boleh dibuat dalam mana-mana hal jika pemohon tunggalnya ialah seorang lelaki dan anak yang berkenaan dengannya permohonan itu dibuat ialah seorang perempuan melainkan jika Mahkamah berpuas hati bahawa terdapat hal keadaan khas yang mewajarkan pembuatan perintah itu sebagai suatu langkah luar biasa.
(3) Sesuatu perintah pengangkatan tidak boleh dibuat bagi faedah mana-mana pemohon yang biasanya tidak bermastautin di Semenanjung Malaysia atau berkenaan dengan mana-mana anak yang tidak bermastautin sedemikian.
(4) Sesuatu perintah pengangkatan tidak boleh dibuat berkenaan dengan mana-mana anak melainkan jika—
(a) anak itu telah berada berterusan dalam jagaan dan milikan pemohon itu selama sekurang-kurangnya tiga bulan berturut-turut sebaik sebelum tarikh perintah itu; dan
(b) pemohon itu telah sekurang-kurangnya tiga bulan sebelum tarikh perintah itu, melalui suatu pemberitahuan bertulis memberitahu seorang pegawai Jabatan Kebajikan Masyarakat Negeri yang dia pada masa itu bermastautin mengenai niatnya untuk memohon bagi mendapatkan suatu perintah pengangkatan berkenaan dengan anak itu.
