s 5 Consents to adoptions
(1) Except as provided in this section, an adoption order shall not be made except with the consent of every person or body of persons who is a parent or guardian of the child in respect of whom
the application is made or who is liable to contribute to the support of the child and an adoption order shall not be made upon the application of one of two spouses without the consent of the other of them:
Provided that the Court may dispense with any consent required by this section if satisfied—
(a) in the case of a parent or guardian of the child, that he has abandoned, neglected or persistently ill-treated the child;
(b) in the case of a person liable to contribute to the support of the child, that he has persistently neglected or refused so to contribute;
(c) in any case, that the person whose consent is required cannot be found or is incapable of giving his consent or that his consent is unreasonably withheld; or
(d) in any case, that in accordance with any written law relating to the adoption of children for the time being in force in any country any competent authority has given permission or granted a licence authorizing the care and possession of the child to be transferred to the applicant.
(2) The Court may dispense with the consent of the spouse of an applicant for an adoption order if satisfied that the person whose consent is to be dispensed with cannot be found or is incapable of giving such consent or that the spouses have separated and are living apart and that the separation is likely to be permanent.
(3) The consent of any person to the making of an adoption order in pursuance of an application (not being the consent of the child) may be given (either unconditionally or subject to conditions with respect to the religion in which the child is to be brought up) without knowing the identity of the applicant for the order; and where consent so given by any person is subsequently withdrawn on the ground only that the identity of the applicant is unknown that consent shall be deemed for the purposes of this section to be unnecessarily withheld.
(4) While an application for an adoption is pending in any Court, any parent or guardian of the child who has signified his consent to the making of an adoption order in pursuance of the application shall not except with the leave of the Court remove the
child from the care and possession of the applicant; and in considering whether to grant or to refuse such leave the Court shall have regard to the welfare of the child.

Persetujuan terhadap pengangkatan
(1) Kecuali sebagaimana yang diperuntukkan dalam seksyen ini, sesuatu perintah pengangkatan tidak boleh dibuat kecuali dengan persetujuan tiap-tiap orang atau kumpulan orang yang merupakan ibu atau bapa atau penjaga anak yang berkenaan dengannya permohonan itu dibuat atau yang bertanggungan untuk memberi sumbangan terhadap saraan anak itu dan sesuatu perintah pengangkatan tidak boleh dibuat atas permohonan salah seorang daripada pasangan suami isteri tanpa persetujuan pihak yang satu lagi:
Dengan syarat bahawa Mahkamah boleh mengetepikan apaapa persetujuan yang dikehendaki oleh seksyen ini jika berpuas hati—
(a) dalam hal ibu atau bapa atau penjaga anak itu, bahawa dia telah meninggalkan, mengabaikan atau sentiasa menganiayai anak itu;
(b) dalam hal seorang yang bertanggungan untuk memberi sumbangan terhadap saraan anak itu, bahawa dia telah sentiasa mengabaikan atau enggan memberi sumbangan sedemikian;
(c) dalam mana-mana hal, bahawa orang yang persetujuannya dikehendaki tidak dapat dijumpai atau tidak upaya memberi persetujuannya atau bahawa persetujuannya telah dengan tidak munasabahnya tidak diberi; atau
(d) dalam mana-mana hal, bahawa mengikut mana-mana undang-undang bertulis yang berhubungan dengan pengangkatan anak yang pada masa ini berkuat kuasa dalam mana-mana negara mana-mana pihak berkuasa kompeten telah memberi kebenaran atau memberikan suatu lesen yang membenarkan supaya jagaan dan milikan anak itu dipindahkan kepada pemohon.
(2) Mahkamah boleh mengetepikan persetujuan suami atau isteri seseorang pemohon bagi suatu perintah pengangkatan jika berpuas hati bahawa orang yang persetujuannya hendak diketepikan itu tidak dapat dijumpai atau tidak upaya memberi persetujuan itu atau bahawa pasangan suami isteri itu telah berpisah dan tinggal berasingan dan bahawa perpisahan itu berkemungkinan kekal.
(3) Persetujuan mana-mana orang terhadap pembuatan sesuatu perintah pengangkatan menurut suatu permohonan (yang bukannya persetujuan anak itu) boleh diberikan (sama ada tanpa syarat atau tertakluk kepada syarat-syarat berkenaan dengan agama yang anak itu akan dibesarkan) tanpa mengetahui identiti pemohon bagi perintah itu; dan jika persetujuan yang diberikan oleh mana-mana orang kemudiannya ditarik balik semata-mata atas alasan bahawa identiti pemohon itu tidak diketahui, persetujuan itu hendaklah disifatkan bagi maksud seksyen ini sebagai telah dengan tidak sepatutnya tidak diberi.
(4) Semasa sesuatu permohonan bagi pengangkatan belum selesai dalam mana-mana Mahkamah, mana-mana ibu atau bapa atau penjaga anak itu yang telah menyatakan persetujuannya kepada pembuatan suatu perintah pengangkatan menurut permohonan itu tidak boleh, kecuali dengan kebenaran Mahkamah, mengambil anak itu daripada jagaan dan milikan pemohon; dan dalam menimbang sama ada hendak memberi atau menolak kebenaran itu Mahkamah hendaklah memberi perhatian kepada kebajikan anak itu.
