s 79 Repeal
The Trade Unions Enactment 1940, of the Federated Malay States, as extended to have effect throughout the Federation by virtue of the Trade Unions Ordinance 1946, and the Trade Unions Ordinance 1946, the Trade Unions Act 1965 [Act 81 of 1965], the Trade Unions and Trade Disputes Ordinance of Sabah and the Trade Unions Ordinance of Sarawak are hereby repealed: Provided that all appointments, regulations, rules made and all certificates issued under such Enactment as so extended and in force at the commencement of this Act shall continue in force and have effect as if they had been made or issued under this Act until other provisions shall be made under this Act. Saving 36. (1) Any application made under the principal Act immediately before the date of coming into operation of this Act and pending under the principal Act shall, on the date of coming into operation of this Act, continue to be dealt with under the principal Act as if the principal Act had not been amended by this Act. (2) Any opinion, order, declaration, refusal, cancellation, withdrawal, direction or decision, made, issued, given or effected under the principal Act immediately before the date of coming into operation of this Act shall, on the date of coming into operation of this Act, continue to remain in force and effect until amended, repealed, rescinded, revoked or replaced. (3) Any action, appeal or proceedings commenced under the principal Act immediately before the date of coming into operation of this Act and pending under the principal Act shall, on the date of coming into operation of this Act, be continued as if the principal Act had not been amended by this Act. *NOTEβsee section 36 of the Trade Unions (Amendment) Act 2024 [Act A1700] w.e.f 15 September 2024 which provides the following provision:
