s 2 Meaning of “workman”
(1) In this Act, unless the context otherwise requires, the expression “workman”, subject to the proviso to this subsection, means any person who has, either before or after the commencement of this Act, entered into or works under a contract of service or of apprenticeship with an employer, whether by way of manual labour or otherwise, whether the contract is expressed or implied or is oral or in writing, whether the remuneration is calculated by time or by work done and whether by the day, week, month or any longer period:
Provided that the following persons are excepted from the definition of “workman”—
(a) any person employed otherwise than by way of manual labour whose earnings, calculated in accordance with section 9, exceed five hundred ringgit a month;
(b) a person whose employment is of casual nature and who is employed otherwise than for the purposes of the employer’s trade or business, not being a person employed for the purposes of any game or recreation and engaged or paid through a club;
(c) a domestic servant;
(d) any person who is a member of the armed forces or of any visiting force lawfully present in Malaysia;
(e) any person in the civil employment of Her Britannic Majesty’s Government in the United Kingdom, or in any other country of the Commonwealth whose contract of service was not made in Malaysia nor in Singapore;
(f) a person employed, or selected for employment, in a civil capacity by the Government of Malaysia or by the Government of any State or by any local authority before 1 April 1953 in the application of this Act in Peninsular Malaysia, and before 1 January 1957 in the application of this Act in Sarawak where, in consequence of injury received by any such person in the discharge of his duties, a pension, gratuity or other allowance which would not be payable if such injury were received otherwise is paid to him or, in the case of his death, to any of his dependants as defined in this Act under any written law for the time being in force in Malaysia or any part thereof providing for the grant of such pension, gratuity or other allowance (this paragraph shall not apply in Sabah);
(g) any police officer, and any other person engaged to perform police duties in accordance with the provisions of any written law while so performing such duties;
(h) an out-worker;
(i) a tributer;
(j) any member of the family of the employer who dwells with him in his house; *(k) any class of persons whom the Minister may declare not to be workmen for the purposes of this Act.
(2) If in any proceedings for the recovery of compensation under this Act it appears to the Commissioner or an Arbitrator or the Court that the contract of service or apprenticeship under which the injured person was working at the time when the accident causing the injury happened was illegal, the Commissioner, the Arbitrator or the Court may, if having regard to all the circumstances of the case he or it thinks proper so to do, deal with the matter as if the injured person had at such time been a person working under a valid contract of service or apprenticeship.
(3) Any reference to a workman who has been injured shall, unless the context otherwise requires, where the workman is dead, include a reference to his legal personal representative or to his dependants or any of them or to any public officer whom the Minister may appoint to act on behalf of the dependants of the workman.

(1) Dalam Akta ini, melainkan jika konteksnya Erti menghendaki makna yang lain, ungkapan "pekerja", "pekerja". tertakluk kepada proviso kepada subseksyen ini, erti- ıya mana-mana orang yang telah, sama ada sebelun atau selepas mula berkuatkuasanya Akta ini, membual atau bekerja di bawah suatu kontrak perkhidmataı atau perantisan dengan seorang majikan, sama ada dengan cara perburuhan kasar atau selainnya, sama ada kontrak itu nyata atau tersirat atau secara lisan atau bertulis, sama ada saraan dikira mengikut masa atau mengikut kerja yang dilakukan dan sama ada mengikut hari, minggu, bulan atau apa-apa tempoh yang lebih lama: Dengan syarat bahawa orang yang berikut dikecualikan daripada takrif "pekerja"—
(a) mana-mana orang yang digaji melainkan [Akıa Pin. cara perburuhan kasar yang A361.] pendapatan tenaganya, dikira mengikut seksyen 9, melebihi lima ratus ringgit sebulan;

(b) seseorang yang pekerjaannya adalah dari jenis sementara dan yang digaji melainkan bagi majikannya, bukannya seseorang yang digaji bagi maksud apa-apa permainan atau rekreasi dan diambil bekeria atau dibayar melalui kelab;
(c) seorang pembantu rumah;
(d) mana-mana orang yang menjadi anggota angkatan bersenjata atau mana-mana ngkatan pelawat yang berada di Malaysi lengan sah
(e) mana-mana orang dalam pekerjaan awam Kerajaan Duli Yang Maha Mulia Raja Britain di United Kingdom, atau di mana-mana negara Komanwel lain yang kontrak perkhidmatannya tidak dibuat di Malaysia
(f) seseorang yang digaji, atau dipilih bagi pekerjaan, dalam sesuatu bidang awam oleh Kerajaan Malaysia atau oleh Kerajaan manamana Negeri atau oleh mana-mana pihak berkuasa tempatan sebelum 1hb April 1953 bagi maksud pemakaian Akta ini di Malaysia Barat, dan sebelum 1hb Januari 1957 bagi maksud pemakaian Akta ini di Sarawak di mana, akibat daripada kecederaan yang dikena dibayar jika kecederaan itu dialami kerana sebab lain dibayar kepadanya atau, dalam hal kematiannya, dibayar kepada manamana orang tanggungannya sebagaimana yang ditakrifkan dalam Akta ini di bawah mana-mana undang-undang bertulis yang edang berkuatkuasa di Malaysia atau mana nana bahagian daripadanya yang memper untukkan bagi pemberian pencen, ganjaran atau elaun lain itu (perenggan ini tidak terpakai di Sabah);

(g) mana-mana pegawai polis, dan mana-mana orang lain yang ditugaskan bagi melaksanakan tugas-tugas polis mengikut peruntukan mana-mana undang-undang bertulis semasa melaksanakan tugas-tugas;
(h) seorang pekerja luar;
(i) seorang pemberi atau pembayar tribute;
(j) mana-mana ahli keluarga majikan yang tinggal bersama-samanya di rumahnya; *(k) mana-mana golongan orang yang boleh Iu.328.) diısytıharkan oleh Menteri sebagai bukan pekerja bagi maksud-maksud Akta ini.
(2) Jika dalam mana-mana prosiding bagi mendapatkan bayaran pampasan di bawah Akta ini ternyata Pesuruhjaya atau Penimbangtar Mahkamah bahawa kontrak perkhidmataı perantisan yang di bawahnya orang yang tercedera itu bekerja pada masa kemalangan yang menyebabkan kecederaan itu berlaku adalah menyalahi undang-undang, maka Pesuruhjaya, Penimbangtara atau Mahkamah itu boleh, jika setelah menimbangkan semua hal-keadaan kes dia atau ia berpendapat adalah wajar untuk berbuat demikian, menguruskan perkara itu seolah-olah orang yang tercedera itu pada masa itu adalah seorang yang bekerja di bawah suatu kontrak perkhidmatan atau perantisan yang sah.
(3) Apa-apa rujukan kepada seseorang pekerja yang [Pin. P.U. telah tercedera, Konteksnya 371/55; mati, hendakimakmaşak rujik,a ikepaka va ildirinya Diubahsuai P.U. 332/58. undang-undang atau orang anggungannya atau mana-mana daripada mereka atal ‹epada mana-mana pegawai awam yang boleh dilantik oléh Menteri untuk bertindak bagi pihak orang tanggungan pekerja itu. *Lihat P.U.
