s 20 Certificate of analyst to be prima facie evidence

In any proceedings under this Act a certificate of analysis purporting to be signed by the analyst shall be accepted as prima facie evidence of the facts stated therein provided that— (i) the party against whom it is produced may require the attendance of the analyst for the purpose of crossexamination if a notice requiring the attendance of the analyst has been given to the prosecution three clear days before the trial; and (ii) no such certificate of the analyst shall be received in evidence unless the party intending to produce it has before the trial given notice to the party against whom it is intended to be produced ten clear days of such intention together with a copy of the certificate.

Perakuan juruanalisis hendaklah menjadi keterangan prima facie

Dalam apa jua prosiding di bawah Akta ini sesuatu perakuan analisis yang berupa sebagai ditandatangani oleh juruanalisis boleh diterima sebagai keterangan prima facie tentang fakta yang dinyatakan dalamnya dengan syarat bahawa— (i) pihak yang terhadapnya perakuan itu dikemukakan mungkin menghendaki kehadiran juruanalisis itu bagi maksud pemeriksaan balas jika suatu notis yang menghendaki kehadiran juruanalisis itu telah diberikan kepada pendakwa tiga hari genap sebelum perbicaraan; dan (ii) tiada satu pun perakuan daripada juruanalisis boleh diterima sebagai keterangan melainkan jika pihak yang bermaksud hendak mengemukakannya telah pun sebelum perbicaraan itu memberi notis sepuluh hari genap tentang cadangan itu berserta dengan satu salinan perakuan itu, kepada pihak yang terhadapnya perakuan itu dimaksud hendak dikemukakan.
