s 23 Offenders as witnesses for prosecution

(1) Whenever two or more persons are charged with any offence against this Act, the Magistrate may require one or more of them to give evidence as a witness or witnesses for the prosecution. (2) Any such person who refuses to be sworn or to answer any lawful question shall be dealt with in the same manner as witnesses so refusing may by law be dealt with by a Magistrate. (3) Every person so required to give evidence who shall, in the opinion of the Magistrate, make true and full discovery of all things as to which he is lawfully examined shall be entitled to receive a certificate under the hand of the Magistrate stating that he has, in the opinion of the Magistrate, made a true and full discovery of all things as to which he was examined, and such certificate shall be a bar to all legal proceedings against him in respect of all such things as aforesaid.

Pesalah sebagai saksi bagi pihak pendakwa

(1) Bilamana dua orang atau lebih dipertuduh dengan apa-apa kesalahan terhadap Akta ini, Majistret boleh menghendaki seorang atau lebih daripada mereka untuk memberi keterangan sebagai saksi atau saksi-saksi bagi pihak pendakwa. (2) Mana-mana orang sedemikian yang enggan mengangkat sumpah atau menjawab apa-apa soalan yang sah hendaklah diperlakukan mengikut cara yang sama seperti saksi-saksi yang enggan sedemikian boleh menurut undang-undang diperlakukan oleh Majistret. (3) Tiap-tiap orang yang dikehendaki sedemikian supaya memberi keterangan yang hendaklah, pada pendapat Majistret, membuat penzahiran yang benar dan penuh mengenai semua perkara yang tentangnya dia diperiksa dengan sah adalah berhak menerima suatu perakuan yang ditandatangani oleh Majistret yang menyatakan bahawa dia telah, pada pendapat Majistret, membuat penzahiran yang benar dan penuh mengenai semua perkara yang tentangnya dia telah diperiksa, dan perakuan sedemikian menjadi suatu halangan ke atas semua prosiding undang-undang terhadapnya berkenaan dengan semua perkara sedemikian seperti yang disebut terdahulu.
