s 35 Duration of patent

(1) Subject to subsections (1B) and (1C), the duration of a patent shall be twenty years from the filing date of the application. (1A) Without prejudice to subsection (1) and subject to the other provisions of this Act, a patent shall be deemed to be granted and shall take effect on the date the certificate of grant of the patent is issued. (1B) Where a patent application was filed before 1 August 2001, and was pending on that date, the duration of the patent granted on that application shall be twenty years from the date of filing or fifteen years from the date of grant, whichever is the longer. (1C) The duration of a patent granted before 1 August 2001 and still in force on that date shall be twenty years from the date of filing or fifteen years from the date of grant whichever is the longer. (2) Where an owner of a patent intends at the expiration of the second year from the date of grant of the patent to keep the same in force he shall, twelve months before the date of expiration of the second and each succeeding year during the term of the patent, pay the prescribed annual fee: Provided, however, that a period of grace of six months shall be allowed after the date of such expiration, upon payment of such surcharge as may be prescribed. (3) If the prescribed annual fee is not paid in accordance with subsection (2), the patent shall lapse, and a notice of the lapsing of the patent for non-payment of any annual fee shall be published in the Official Journal.

Jangka masa bagi paten

(1) Tertakluk pada subseksyen (1B) dan (1C), jangka masa sesuatu paten hendaklah dua puluh tahun dari tarikh pemfailan permohonan. (1A) Tanpa menjejaskan subseksyen (1) dan tertakluk pada peruntukan lain Akta ini, suatu paten hendaklah disifatkan diberikan dan berkuat kuasa pada tarikh perakuan mengenai pemberian paten itu dikeluarkan. (1B) Jika sesuatu permohonan paten telah difailkan sebelum 1 Ogos 2001, dan belum selesai pada tarikh itu, jangka masa paten yang diberikan berdasarkan permohonan itu hendaklah dua puluh tahun dari tarikh pemfailan atau lima belas tahun dari tarikh pemberian mengikut mana-mana yang lebih lama. (1C) Jangka masa sesuatu paten yang diberikan sebelum 1 Ogos 2001 dan masih berkuat kuasa pada tarikh itu hendaklah dua puluh tahun dari tarikh pemfailan atau lima belas tahun dari tarikh pemberian mengikut mana-mana yang lebih lama. (2) Jika seseorang pemunya paten bercadang untuk terus menguatkuasakan paten itu apabila habis tempoh tahun kedua dari tarikh paten itu diberi, dia hendaklah dalam masa dua belas bulan sebelum tarikh habis tempoh tahun kedua dan tiap-tiap tahun yang berikutnya dalam tempoh berkuatkuasanya paten itu, membayar fi tahunan yang ditetapkan: Dengan syarat, bagaimanapun, bahawa suatu tempoh pertangguhan selama enam bulan bendaklah dibenarkan selepas habis tempoh itu, setelah pembayaran surcaj sebagaimana yang ditetapkan. (3) Jika fi tahunan yang ditetapkan tidak dibayar mengikut subseksyen (2), paten itu hendaklah luput, dan notis tentang luputnya paten itu kerana apa-apa fi tahunan tidak dibayar hendaklah disiarkan dalam Jurnal Rasmi.
